Payment and cancellation terms:
- Booking deposit: 25% of the rental price, non-refundable if you cancel your booking.
- Balance: payable 60 days before your arrival date, 50% refundable for cancellations up to 30 days before arrival.
- Cleaning, service charges and taxes are fully refundable should you need to cancel at any time.
- Damages deposit: payable 1-2 weeks before your arrival date via PayPal fully refundable after you leave, in accordance with the rental terms and conditions. 

Detailed terms and conditions

Booking Conditions and Rental Terms for La Maison de Proméry

 

The following booking conditions (the “Conditions”) are between the property owners Sue and Mark Penrose (“we”, “us” and “our”) and the holidaymaker(s), hereafter referred to as the “guests” who book our property, “La Maison de Proméry”, situated at 18 Chemin du Maréchal, Pringy, 74370 Annecy, France (the “Property”). References to “you” or “your” are references to the person making the booking and all members of your group. Any booking is subject to the Conditions, which form the basis of your contract with us (the “Rental Agreement”). Nothing in these Conditions will affect your normal statutory rights.

 

The rental property

 

This Rental Agreement is for a detached house with a private garden, rated as four-star holiday accommodation by the Haute Savoie Tourist Board (see the classification certificate in Appendix).

The Property is in a quiet hamlet called Proméry, within Pringy, one of the Greater Annecy districts north of Lake Annecy and 6.4 km from its medieval town centre.

 

Making your booking

 

To book the Property you should make the payments specified in our quote (the “Quote”). If the Quote stipulates that you pay an initial deposit (the “Booking Deposit”) followed by or at the same time as a balance payment (the “Balance”), you must make both payments within the time periods specified. The Booking may be treated as cancelled by you if you fail to make a due payment in full and on time.

 

Once the Booking Deposit has been received, we will send confirmation of the Booking. The contract between us will only be formed when you receive the payment confirmation email and will be subject to these Conditions.

 

Rental period and key collection

 

The rental period starts from 4pm on your arrival date and ends no later than 10am on your departure date. On changeover days the property needs to be prepared for incoming guests, so it is very important that you respect the 10am check out time. Should you be unable to do so, we may need to hire additional cleaning staff at the last minute, the cost of which will be charged against your deposit. If you delay your departure to such an extent that it will no longer be possible for the incoming guests to check in on time, we will be obliged to find alternative accommodation of an equivalent quality for them, the cost of which will have to be charged against your deposit. This will not in any way extend the period of your short-term tenancy in the property.

 

We understand that there may be delays with International travel, so to remove the stress of having to arrive by a particular time, we provide a key safe, the code for which will be sent to you once all due payments, including the damages deposit have been received.

 

Rental price, occupancy and cancelation conditions

 

The rental price does not include the Annecy tourist tax, or any additional guest fees which may apply, for example for groups with more than six guests, or for cleaning linens and utilities. The linen provided includes bed linen, household linen and towels. There is unlimited high-speed Internet access via Wi-Fi and telephone calls to standard French lines and mobiles are free of charge. Please note that the property is in a mountainous region, subject to adverse weather conditions and even though the service is usually very reliable, the owner cannot be responsible for any interruptions to the provision of Internet and telecoms services by the provider.

 

The property is let on the basis of the guest numbers declared in this contract, following payment of the full rental amount and a fully refundable damages deposit. Please inform the owner of any changes to the number of guests, so that we can make up the right number of beds and amend the tourist tax and any additional guest fee accordingly. For your comfort, please do not exceed the maximum number of 10 guests.

 

A non-refundable Booking Deposit of 25% of the total rental amount will be payable to reserve the Property. The Balance Payment will become due 60 days before your arrival date.

Cancelation Policy: Any Balance Payment made before the due date will be refunded in full and 50% of the balance will be refunded for cancelations made by the guest up to 30 days before the Arrival Date.

 

If you cancel or amend the Booking you must write to us or email us as soon as possible. A cancellation will not take effect until we receive written confirmation from you.

 

If we cancel or amend your booking we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your Booking. We would not expect to have to make any changes to your Booking, but unforeseen problems can occur, which would oblige us to cancel a Booking. If this does happen, we will refund you 100% of any fees you have already paid to us. However, we will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities or insurance). For this reason it is important that you take out adequate travel insurance covering you for cancelation in valid circumstances where your holiday property is no longer able to be let.

 

The Damage Deposit and inventory.

 

Before we can release the keys, a Damage Deposit of €1000 must have been received in cleared funds. We will send a PayPal invoice for payment two weeks before your arrival date. It will not be possible to pay by cheque or cash on arrival. The Damage Deposit is fully refundable should you need to cancel your Booking.

 

The inventory and condition of the property will be checked prior to and immediately after you leave. We will return the Damage Deposit to you following the return of the keys to us, normally the same day, or within a maximum period of 30 days if any deductions are deemed necessary. In this rare situation the Damage Deposit may be used for any repair and/or replacement of the Property, furnishings, fixtures, fittings and equipment that is necessary after your stay, or for any damage to the garden. Such items will have been listed on an inventory that will have been left for you to verify on arrival and quotes will be sent to you before any deductions are made. Should you need to leave early, or our housekeeper is unable to conduct your check out personally, please note any damage or items requiring replacement on the inventory, which will be checked later.

 

Your obligations

 

You agree to take all necessary steps to safeguard the owners’ property and your personal property, including securing all doors and windows when you are not inside the property and by not smoking inside the property.

 

You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, the barbecue, crockery and glasses clean and in good condition. You agree not to wilfully cause damage to the walls, parquet flooring, doors, windows or any other part of the Property, nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to the occupiers of neighbouring properties. The Property is in a quiet residential area, so it would be considerate not to make unreasonable noise outside on the terraces after 11pm from Sunday to Thursday and after midnight on Fridays and Saturdays.

 

You agree to ensure that each guest is covered by comprehensive travel insurance, including personal liability (third party), cancellation, flight delays and other property, health insurance (including evacuation and repatriation coverage).

 

You agree not to allow more people to stay in the Property than expressly authorised.

 

You agree not to bring pets to the Property without our express permission. Should you do so, a minimum of 25% of the Damage Deposit will be retained, with the option to increase this to the full amount of the Damages Deposit if necessary, to cover additional cleaning, inspection for/treatment against flea infestation, in addition to the cost of any damage caused. Whether we authorize your bringing a pet or not, we do not accept liability for harm caused to others or damage to others’ property caused by that pet.

 

You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs or in an emergency and for the gardeners to cut the lawns, water and tidy the garden and flowers. In winter we will do our best to ensure that the access to the property (parking area and pathway) is cleared of snow for your arrival. However, this cannot be guaranteed as we could be caught out by a freak snowfall at the last minute, which cannot be cleared in time. During your stay it will be your responsibility to keep the parking area and pathway clear of snow. We will provide a snow shovel and salt for the pathway, which can get slippery. Help will generally be on hand if you are unable to clear the snow yourselves, but cannot be guaranteed immediately. The owner does not accept responsibility for any accidents caused by pathways that are not properly cleared.

 

What to do when you leave

 

Even though a contribution towards cleaning was added to your rental price, this assumes that you will return the house to us in a reasonable state of cleanliness and tidiness, with all rubbish put into the main outside bin and glass waste taken to the recycling containers in the village, washing up done and put away and the barbecue cleaned if you have used it.  Beds should be stripped with the bedding left folded on the bed it came from and used towels should be left in the laundry area of the basement. Should it be necessary for us to hire additional cleaning staff on changeover days because the property has not been left in a reasonable condition, the cost of this will be charged against the damages deposit on the basis of 40€ per hour.

 

In situations where it is not possible to check you out personally, please secure the property by closing all windows and shutters, locking the front and back doors and leaving the keys in the key safe, with the dials turned so that it cannot be opened again without the code. Please do not attempt to change the access code without our permission, otherwise we may be unable to use the safe again and would need to charge for a replacement.

 

Complaints

 

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible. Please contact us if any problem arises so that it can be speedily resolved. If any complaint cannot be resolved during your holiday, please write to us with full details within 28 days of the end of your stay.

 

Our liability

 

Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you.

 

We shall not be liable to you for any personal injury or damage to or loss of personal property, except where the injury, damage or loss is caused by our negligence. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit our liability.

 

General

 

You may not transfer your Booking or any rights and responsibilities under these Booking Conditions to any other person, without our prior written consent.

 

If at any time, any part of these Booking Conditions is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission.

 

This Rental Agreement and Booking Conditions, together with the Quote and Cancellation Policy contains the entire agreement between us and you relating to the Booking and supersedes any previous agreements, arrangements or discussions. Please check and complete the details on the front page of this Agreement, accept the Conditions and return a signed copy to us.

The following classification as 4 star furnished holiday accommodation for 8 guests was awarded following inspection by the Haute-Savoie Tourist Board (UDOTSI 74 “l’Union Départementale des Offices de Tourisme et des Syndicats d’Initiative de Haute-Savoie”) on 11th June 2012.
